These Terms of Use ("Terms" or "Terms of Use"), provided by Xlabs Dijital Hizmetler Anonim Şirketi ("We," "Our," "Us" or "Flexy"), set forth the legally binding terms and conditions that govern Your access and/or use of: (a) our mobile app, the "Flexy App" (which you can download to use from the Apple App Store), and (b) any information or materials We provide You through the Flexy App or any of Our other services (collectively, the "Services").

By accessing or using any of the Services, You accept and agree to be bound by these Terms (which incorporate by reference Our Privacy Policy). You represent and warrant that You have the right, authority, and capacity to enter into these Terms.

All capitalized terms not defined in these Terms of Use are defined in Our Privacy Policy.

If You do not agree to all of these Terms, do not access or use the Services.

ELIGIBILITY You must be 13 years of age or older to use Our Services. You must be 18 years of age or older to purchase any paid Services.

If applicable law requires You (or Your child) to be older to use, access, or purchase the Services, then the Minimum Age will be that older age.

These Terms May Change We may update these Terms from time to time. When We do, We will post the revised Terms within the Flexy App and/or notify You by other reasonable means. Your continued use of Our Services following the update means that You accept and agree to the revised Terms.

Read Our Privacy Policy Any information We collect through Your use of the Services is subject to Our Privacy Policy, which is part of these Terms.

HEALTH AND SAFETY WARNINGS AND DISCLAIMERS The Flexy App and Services may include content that promotes physical activity, stretching, and wellness. These are for informational purposes only and are not intended as medical advice or services, or for diagnostic or treatment purposes.

You are responsible for considering the risks involved and consulting with Your medical professional before engaging in any physical activity. By using Our Services, You acknowledge and agree that: (a) You have consulted a healthcare professional prior to using any Flexy content; (b) if You choose not to consult with a healthcare professional, You assume all related risks; (c) You use the Services at Your own sole risk.

Our Services may use automated or algorithmic systems to suggest exercises or routines. These suggestions are informational only and not a substitute for professional medical advice, diagnosis, or treatment. Flexy is not responsible for any harm resulting from use of these features.

ACCOUNTS Flexy does not require You to create an account. You may use the App anonymously without registration.

THE SERVICES License. Subject to these Terms, We grant You a limited, non-exclusive, non-transferable, revocable license to access and use the Services for Your personal, non-commercial use.

Restrictions. You may not:

Copy, modify, distribute, sell, or lease any part of the Services;
Reverse engineer or attempt to extract the source code of the App;
Use the Services to create a competing product;
Upload or distribute unlawful, threatening, or objectionable content;
Use automated systems to extract data from the Services.

INTELLECTUAL PROPERTY All content in the Services, including text, images, videos, and code, is owned by Us or our licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from the content without Our written permission.

CHANGES TO THE SERVICES We may change or discontinue the Services at any time without notice. We are not liable to You or others for any modifications, suspensions, or discontinuations.

INDEMNIFICATION You agree to indemnify and hold Us harmless from any claims or liabilities arising from Your use of the Services, violation of these Terms, or infringement of any rights.

DISCLAIMER FLEXY IS NOT A MEDICAL SERVICE. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Services will be secure or free of errors or interruptions.

LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLEXY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE PAST SIX MONTHS.

TERMINATION We may suspend or terminate Your access to the Services at any time, for any reason. Upon termination, Your right to use the Services will end immediately.

GOVERNING LAW AND JURISDICTION These Terms shall be governed by the laws of the Republic of Turkey. Any disputes arising under or in connection with these Terms shall be resolved in the courts of Istanbul (Çağlayan), Turkey.
